The conviction of Santosh Kumar for Mattoo's murder has just created a new faith in Indian judiciary. And this will have a far reaching effect if it is taken as a wakeup call by all citizens.The conviction of Santosh Kumar Singh by the Delhi High Court after almost 7 years for murder of 23-year-old Priyadarshini Mattoo has come as a major surprise to me.
It proves that judiciary in our country is not dysfunctional and delivers justice though after some delay. The landmark judgment will set a precedent for future criminals and will act as a deterrent. I feel proud that no matter how high profile the case is, there is no escaping the law of the land and guilty will be brought to notice.
The harsh judgment shows that India is not a country where the high and mighty can escape the crutches of the law though the lower courts allowed the accused to go scotfree due to insufficient evidence. Here again, the sustain campaign by celebrities, media, the commoners, the youth sealed the fate of the accused, Santosh Kumar. Talking of other cases, in recent months too, many superfluous PILs are just wasting the prime time of the courts. To be fair to one and all, the judiciary should highlight the cases of social, law and order, cultural, national issues etc on a priority basis... and not indulge in unnecessary judicial adventure. Every wing of democracy should work within their purview to allow the Constitution to function effectively and regularly.Nowadays, it seems that the lower courts can be subverted to the will of the high and mighty but the higher court and Supreme Court are still held in high reverence. They are delivering and are concerned with the interests of the common men. The recent verdict in cases involving Mohammad Afzal, Jessica Lall, Nitish Katara etc shows that the judiciary is showing spine. I have no doubt in accepting that the Indian legal system despite huge obstacles of less staffers, fewer judges, less courts, poor infrastructure and add to that nearly 3 crore cases (2 crore civil and 1 crore criminal cases) are doing a wonderful job. Indirectly, the courts are giving a message that sooner or later the law will take its course till justice is finally done. Regarding the role of the media, I think that in this age without it, nothing substantial can be done. The clamour and awareness it created led worked wonders on the judges, police, law enforcing agencies, common men so that the accused can be severely convicted. But again, the media only highlightz those cases which will enhance their TRPs. Media should try to focus those cases also in the interiors of our country where several Mattoos, Jessicas etc die unsung and unheard. Then only the true purpose of the Fourth Estate of democracy will be viable and will make our democracy more vibrant and active. The media must understand that it has certain limitations and they have to work under their own limitations.The role of youth in this case needs to be taken into account. The accused has working parents and hence parents spent very less time with him. Secondly, being a son of an IPS Officer has just made him feel above everyone and he grew up as a spoilt brat. Hence, his heinous act could be attributed to his wayward ways, which were sown in early childhood. In today's society, we could have thousand examples of parents trying to shower their children with gifts and material goods to make up for their absence from home. As a result, the child grows with lot of mental problems making it difficult for him to cope with life and finally he chooses the wrong path. Too much of wealth, mobiles, gadgets, money has spoiled the younger generation making them forget the value of money. It has also resulted in the loss of values and ethics for the youth. So, the youth need certain lessons in life as guidance and spiritual classes are a must for them. For instance, look at the difference in the movie Don. In the Amitabh-starrer film, the good triumphs over evil as the villain is killed in the end. But in the latest Shah Rukh Khan-starrer, the bad succeeds in the end which just sends a wrong message to the teens. However, the most important role in modern day is that of parents. Their role is critical which will have a bearing on the future generation. Not only them, even politicians, leaders, and other professional speak lies with impunity thus having bad affect on impressionable minds. Then, how can they think their ward to become nice and good when they themselves are indulging in all kinds of bad behaviour? To our horror, the greatest casualty has been the trust in relationships, which has hit rock bottom. The kids are just imitating their parents and hence we see the modern generation bereft of ethics and values.Years ago Jawaharlal Lal Nehru said: 'Freedom comes with responsibility' and at this moment we must remember that responsibility which is entrusted on us. Whatever the judgment says, there is still no respite for the common men who is still too poor to seek justice.
